This Fair Use Policy ("FUP" or "Policy") is an integral part of the Terms of Service between Bluedot Technology, LLC ("DocuPal," "we," "us," or "our") and you, the user ("user," "you," or "your"). This Policy outlines the principles, guidelines, and conditions governing the acceptable use of DocuPal's AI-assisted document writing tool, website, and related services (collectively, the "Service").
The primary purpose of this FUP is to ensure that all users of the Service enjoy equitable, reliable, and high-quality access to our resources. It aims to prevent excessive, abusive, or improper use that could impair the Service's performance, availability, or security for other users, or lead to disproportionately high operational costs for DocuPal. By using the Service, you agree to comply with this Fair Use Policy.
2. Definitions of Fair Use
- Fair Use (in the context of this Policy): Refers to the reasonable and proportionate use of the Service's resources, consistent with the intended purpose of an AI-assisted document writing tool for business and professional needs. It requires users to operate in a manner that does not negatively impact the experience of other users or the overall stability and integrity of the Service.
- Scope: This Policy applies to all aspects of the Service, including but not limited to AI-generated content (measured in words, tokens, or other units), data storage, bandwidth, API usage (if applicable), and any other shared computational or network resources.
- Intent: The intent of this Policy is to define acceptable usage patterns and to deter activities that, whether intentional or unintentional, strain the Service's infrastructure, compromise its security, violate legal or ethical standards, or deviate significantly from typical usage patterns anticipated for the user's subscription plan (including Limited Lifetime Deals).
3. Use of Service and Resources
All use of the Service is subject to this Fair Use Policy. DocuPal provides various subscription plans, including potentially Limited Lifetime Deals (LTDs), which may offer generous or seemingly "unlimited" access to certain features. However, such descriptions are always conditioned by the principle of fair use. "Unlimited" does not mean infinite, nor does it permit usage patterns that are abusive, wasteful, or that negatively impact the Service or other users.
Eligible activities under this FUP generally include:
- Generating, drafting, editing, and refining documents for legitimate personal or business purposes.
- Utilizing AI assistance for brainstorming, content creation, and summarization within reasonable limits.
- Storing and managing documents created or uploaded through the Service in accordance with your plan's storage allocations.
4. Limitations, Restrictions, and Thresholds
While specific quantitative limits (e.g., word/token counts, storage capacity) are often detailed on our Pricing Page or in the terms of your specific subscription or LTD, this FUP applies universally. Usage that is consistently at the extreme end of these limits or exhibits patterns indicative of abuse may be subject to review and action under this Policy.
- General Resource Consumption: Users must not consume resources in a manner that is excessive or disproportionate to typical usage for their plan. This includes, but is not limited to, server processing power, database load, and network bandwidth.
- AI Generation (Tokens/Words):
- AI-powered features consume computational resources, often measured in "tokens" or "words." Each subscription plan, including LTDs, is designed with certain usage expectations in mind.
- Extremely high-volume, rapid, or automated generation requests that mimic bot activity, are intended to systematically mine data, reverse-engineer models, or are otherwise not reflective of genuine interactive use for document creation are prohibited.
- Limited Lifetime Deals (LTDs):
- LTDs grant long-term access to specified Service features. To ensure sustainability and fair resource allocation, LTDs are typically provisioned with a finite number of AI generation tokens (or an equivalent resource unit) that are distributed on a recurring basis (e.g., monthly or annually), as specified in the terms of the specific LTD offer at the time of purchase.
- This recurring allocation is designed to provide substantial ongoing value. Once the allocated tokens for a given period (e.g., month or year) are consumed, LTD users may need to wait until the next allocation period for their tokens to replenish. DocuPal may, at its discretion, offer LTD users the option to purchase additional token packs if available.
- The specific number of tokens, their renewal frequency, and any other resource limits for LTDs are defined at the point of purchase and are subject to this Fair Use Policy.
- Prohibited Automated Use: Using scripts, bots, or other automated means to access or interact with the Service in a way that circumvents normal usage patterns, exceeds reasonable request rates, or attempts to perform bulk operations not explicitly supported by an official DocuPal API, is strictly prohibited.
- Storage and Bandwidth: Users must adhere to the storage limits specified in their plan. Excessive uploading or downloading of data unrelated to the core purpose of the Service, or using the Service primarily as a file-hosting or content delivery network, is not permitted.
5. Examples of Permissible and Impermissible Use Cases
- Permissible Use Cases:
- Regularly generating various business documents (e.g., proposals, reports, marketing materials, emails, legal drafts) in line with typical operational needs.
- Utilizing AI features interactively to draft, refine, and brainstorm content for multiple projects, with usage spread over time.
- For LTD users: Utilizing their allocated monthly or annual tokens for legitimate document creation tasks throughout the respective period.
- Storing documents created and used in the course of normal business activities within plan limits.
- Impermissible Use Cases:
- Operating automated scripts or bots to continuously generate vast quantities of content for purposes such as data farming, content spinning beyond reasonable paraphrasing, or stress-testing.
- Sharing account credentials with multiple individuals to allow them to collectively exploit a single subscription's features or token allowances, thereby circumventing proper licensing.
- Systematically attempting to exhaust or abuse LTD token allocations through non-genuine, high-velocity usage, or attempting to pool/sell/transfer token allocations.
- Using the Service to generate spam, unsolicited bulk communications, or content for illegal, unethical, or malicious activities.
- Consistently hitting resource usage ceilings (e.g., token limits, API rate limits if applicable) in a manner that indicates automated abuse rather than genuine human interaction.
- Any attempt to reverse-engineer, decompile, or discover the underlying models, algorithms, or proprietary components of the Service through excessive or specifically crafted queries.
- Using the Service for any form of load testing or benchmarking of DocuPal or third-party services without our explicit prior written consent.
- Reselling or sublicensing access to your DocuPal account or any of its features without a formal reseller agreement with DocuPal.
6. Requirements for Attribution and Acknowledgment
- Users are responsible for the final content generated and its use. While DocuPal provides AI assistance, you must ensure the accuracy, legality, and appropriateness of the content.
- Attribution to DocuPal for content generated through the Service is generally not required for your standard internal or external business documents.
- However, users must not misrepresent AI-generated content as purely human-authored if transparency is mandated by ethical guidelines, legal obligations, specific platform policies (where the content is published), or academic integrity rules.
- Users must not remove, obscure, or alter any DocuPal branding, copyright notices, or other proprietary markings embedded within the Service interface or any accompanying documentation.
7. Monitoring, Enforcement, and Reporting Violations
- Monitoring: DocuPal reserves the right to monitor overall system usage, resource consumption patterns (including token/word generation, API calls, storage use), and compliance with this Fair Use Policy. Monitoring may be conducted through automated systems and, where deemed necessary, manual review. This is essential for maintaining service stability, ensuring equitable resource distribution, identifying security threats, and detecting potential violations of this Policy or our Terms of Service.
- Enforcement: If DocuPal determines, in its sole discretion, that a user's activity violates this Fair Use Policy or otherwise constitutes abuse of the Service, we may take one or more of the following actions, with or without prior notice depending on the severity of the violation:
- Issuing a warning to the user detailing the non-compliant activity.
- Imposing temporary or permanent restrictions on access to certain features or resources (e.g., rate limiting, reducing token allocations, temporarily throttling access).
- Suspending the user's account.
- Terminating the user's account in accordance with our Terms of Service. No refunds will be provided for termination due to violation of this FUP.
- For LTD users, persistent or severe abuse may lead to a review and potential adjustment of their token allocation, or in extreme cases, termination of the LTD access without refund or compensation.
- Taking any other action deemed appropriate to address the violation and protect the Service and its users. Where feasible and appropriate, DocuPal will attempt to contact the user to discuss the problematic usage and provide an opportunity for remediation. However, for critical violations, actions may be immediate.
- Reporting Violations: If you become aware of any user activity that you believe violates this Fair Use Policy, please report it to us promptly. You can submit a report through our Contact Page or by emailing legal@bluedot.ltd. Please provide as much detail as possible to assist in our investigation. DocuPal will review all reports and take appropriate action at its discretion. To protect privacy, the outcome of investigations may not be disclosed to the reporter.
8. Specific Considerations for Limited Lifetime Deals (LTDs)
As stated in Section 4, LTDs are designed to offer significant long-term value but are explicitly subject to this Fair Use Policy to ensure the sustainability and quality of the Service for all users.
- Tokenized Resource Allocation: LTDs are provided with a specific, finite number of AI generation tokens (or equivalent resource units) that are allocated on a recurring basis (e.g., monthly or annually). This is a fundamental aspect of the LTD offering.
- Fair Usage Expectation: LTD users are expected to utilize their allocated resources in good faith for genuine document creation needs over the allocation period. Usage patterns that indicate an attempt to rapidly exhaust resources for purposes other than standard interactive document creation, or to support commercial activities beyond the scope of an individual user's plan (e.g., offering a service powered by your LTD account), are considered a violation of this FUP.
- Sustainability: DocuPal reserves the right to adjust resource allocation methods or implement additional fair use measures for LTDs if aggregate usage patterns threaten the overall health, performance, or economic viability of the Service. Any such changes applicable to existing LTD holders would be communicated in advance where practicable.
9. Policy Modifications
DocuPal reserves the right to modify this Fair Use Policy at any time. Any changes will be effective immediately upon posting the revised Policy on our website and updating the "Effective Date." We will make reasonable efforts to notify users of material changes, such as via email or a notice within the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Fair Use Policy.
